On March 14, 2024, EPA announced final amendments to the Gasoline Distribution National Emission Standards for Hazardous Air Pollutants (NESHAP) and final updates to the New Source Performance Standards (NSPS) for Bulk Gasoline Terminals. According to EPA’s news release, the action will apply to storage tanks, loading operations, and equipment leaks but will not apply to gasoline stations.

EPA estimates that approximately 210 gasoline distribution facilities are subject to the major source NESHAP and approximately 9,260 sources are subject to the area source NESHAP.

Fact Sheet Summarizes the Action
According to EPA’s Fact Sheet, the gasoline distribution facilities covered by the action are bulk gasoline terminals and bulk gasoline plants with throughput at or above 20,000 gallons per day; pipeline breakout stations; and pipeline pumping stations. The Fact Sheet identifies these key regulatory components:

• Volatile organic compound (VOC) emission limits for the bulk gasoline terminal NSPS at affected facilities that commence construction, reconstruction, or modification after June 10, 2022
• Lower loading rack emission limits
• Strengthened cargo tank vapor-tightness requirements
• Additional storage tanks controls in the major and area source NESHAP
• Instrument monitoring to detect equipment leaks
• Monitoring and operating requirements for control devices, including recordkeeping and reporting
• Submission of compliance reports electronically
• Removal of startup, shutdown, and malfunction exemptions so that the standards always apply
