Copyrightable subject matter can originate from various sources—an individual, an employee, or an independent contractor. Therefore, it is crucial to establish who will own the work before creation and to secure that ownership thereafter. To address the appropriate need, the Intellectual Property Practice Group may build a team including members drawn from the Labor and Employment Practice Group and the Business and Transactions Practice Group.

Our approach is to ensure that any copyright generated by an employee in the course of their employment is unequivocally owned by the employer. We also recognize that artistic expressions created on personal time should remain with the individual. Furthermore, we take steps to clearly define ownership of works produced by independent contractors. Once these ownership issues are clarified, we proceed to obtain copyright registration for the relevant works with the Copyright Office at the Library of Congress.
