EPA Proposes New Renewable Fuel Standards

2020 Environmental Real Estate Issues

On June 13, 2025, EPA proposed “Renewable Fuel Standard (RFS) volume requirements for 2026 and 2027.” In its news release, EPA said the proposal “ensures the RFS program remains true to Congress’ original intent of increasing the use of homegrown American biofuels, unleashing American energy, and supporting rural economies.”

The proposal would set “the highest volume requirements ever under the RFS program.”

Reducing the Value of Foreign Sources and Removing Electricity
The proposal sets strong growth targets for key renewable fuels.

It reduces the value of renewable fuels and feedstocks from foreign countries. Currently, biofuels and feedstocks have the same value regardless of source. Under the “America first” component of the proposal, “foreign biofuels and feedstocks are only being provided 50 percent of the value relative to domestic biofuels and feedstocks.”

The proposal also advances the Trump administration’s “goal of eliminating the electric vehicle (EV) mandate, by removing electricity as a qualifying renewable fuel under the RFS program.”

Testimony and Written Comments
EPA will host a virtual public hearing on July 8, 2025, which will allow individuals to give up to three minutes of testimony regarding the proposal. EPA will accept written comments submitted on or before August 8, 2025.
